These Terms of Use (the "Terms") form a binding agreement between you and Gallant Labs ("we", "us", or "our"), a studio based in Montréal, Québec, Canada, governing your use of the ALTE mobile application for iPhone, iPad, and Apple Watch, and any related services (together, "ALTE" or the "Service").
By downloading, accessing, or using ALTE, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use ALTE.
1. Eligibility
You must be at least 13 years old to use ALTE. If you are under the age of majority in your province or country of residence, you may use ALTE only with the involvement and consent of a parent or legal guardian. By using ALTE, you represent that you meet these requirements.
2. Your licence to use ALTE
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use ALTE on Apple devices that you own or control, for your own personal, non-commercial use. We reserve all rights not expressly granted to you.
This licence is in addition to Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple EULA. If there is any conflict between these Terms and the Apple EULA with respect to your use of ALTE obtained through the App Store, the Apple EULA governs to the extent of that conflict. See Section 11 for additional App Store terms.
3. Subscriptions and billing
ALTE offers an auto-renewing subscription, ALTE Pro, which unlocks the app's full functionality. A free trial may be offered to new subscribers.
- Subscriptions are sold and billed by Apple through your Apple ID, subject to Apple's terms. Prices are shown in the app and may vary by region.
- Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
- If a free trial is offered and you do not cancel before it ends, your subscription will begin and your Apple ID will be charged.
- You can manage or cancel your subscription at any time in your Apple ID subscription settings (Settings → your name → Subscriptions). Cancelling stops future renewals; it does not retroactively refund the current period.
- Payments are non-refundable except where required by law or by Apple's applicable refund policy. Refund requests are handled by Apple.
- We may change subscription pricing or features. Where required, changes to a renewing price will take effect only after notice and, where applicable, your consent.
4. Health and fitness disclaimer
ALTE is a personal tracking tool, not a medical device or a provider of medical advice. The information, charts, insights, calorie and macro estimates, and other outputs in ALTE — including those generated by AI food logging or drawn from third-party nutrition databases — are for general informational purposes only and may be inaccurate or incomplete.
ALTE does not provide medical, nutritional, or professional advice and is not a substitute for consultation with a qualified healthcare provider. Always seek the advice of your physician or another qualified professional before beginning, changing, or stopping any diet, exercise, supplement, or health program, and never disregard professional advice because of something you read or logged in ALTE. You use ALTE and act on its information at your own risk.
5. Your data and content
The data you log in ALTE is yours. You are responsible for the accuracy of the information you enter and for how you use ALTE's outputs. We handle your information as described in our Privacy Policy, and ALTE lets you export your data at any time. You are responsible for keeping your own backups; while ALTE syncs through your private iCloud, we are not responsible for data loss.
6. Acceptable use
You agree not to:
- use ALTE for any unlawful purpose or in violation of these Terms;
- copy, modify, distribute, sell, or lease any part of ALTE, except as expressly permitted;
- reverse engineer, decompile, or attempt to extract the source code of ALTE, except to the extent applicable law expressly permits;
- interfere with, disrupt, or attempt to gain unauthorized access to ALTE, our backend services, or any related systems; or
- use any automated means to access ALTE in a way that places an unreasonable load on our services, including the AI features, beyond their normal usage limits.
7. Third-party services
ALTE works with and relies on third-party services, including Apple HealthKit and iCloud, the FatSecret Platform API, Open Food Facts, Health Canada's Canadian Nutrient File (CNF), RevenueCat for subscription management, and Cloudflare for the backend that powers the AI features. Your use of these features may be subject to those providers' own terms and policies. We do not control and are not responsible for the accuracy, availability, or content of third-party services, including the accuracy of any nutrition data.
8. Intellectual property
ALTE, including its software, design, the ALTE name, logo, and wordmark, and all related content (excluding the data you log) is owned by Gallant Labs and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
9. Disclaimer of warranties
To the fullest extent permitted by applicable law, ALTE is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that ALTE will be uninterrupted, error-free, secure, or that any data, estimate, or insight it provides will be accurate or reliable.
10. Limitation of liability
To the fullest extent permitted by applicable law, Gallant Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) ALTE. To the extent we are found liable, our total liability will not exceed the greater of the amount you paid us for ALTE in the twelve months before the claim, or CAD $50.
Some jurisdictions, including Québec, do not allow certain limitations or exclusions of liability or warranties. Where that is the case, the above limitations apply only to the extent permitted by law, and nothing in these Terms limits rights you have that cannot be waived under applicable consumer-protection law.
11. Apple App Store
The following applies because you obtained ALTE through Apple's App Store:
- These Terms are between you and Gallant Labs only, and not with Apple. Apple is not responsible for ALTE or its content.
- Apple has no obligation to provide any maintenance or support for ALTE. Any questions or support requests should be directed to us at the contact below.
- In the event ALTE fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to ALTE.
- Apple is not responsible for addressing any claims relating to ALTE, including product-liability claims, claims that ALTE fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
- Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that ALTE infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
12. Changes to ALTE and to these Terms
We may update, change, or discontinue ALTE or any of its features at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes will be made apparent in the app or on this page. Your continued use of ALTE after changes take effect means you accept the revised Terms.
13. Termination
You may stop using ALTE at any time. We may suspend or terminate your access to ALTE if you breach these Terms or use ALTE in a way that could cause harm to us or others. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will survive.
14. Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Subject to any mandatory rights you have under applicable consumer-protection law, you agree that the courts located in Québec, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or ALTE.
